Winter Giveaway

1.1 The WINTER GIVEAWAY ("Promotion") is conducted by Tas Divers Pty Ltd t/as ScubaGearOnline (ABN 96 677 555 510) of 6/38 Mertonvale Circuit Kingston TAS 7050 ("Promoter").

1.2 The Promotion commences at 17:00 AEST on 20th July 2026 and closes at 23:59 AEST on 3rd August 2026 ("Promotion Period").

1.3 This Promotion is a game of chance.

2.1 The Promotion is open to Australian residents aged 18 years or over, except: (a) employees (and their immediate families) of the Promoter, its associated agencies, or any company involved in the conduct of this Promotion.

2.2 By entering, entrants agree to be bound by these Terms and Conditions.

3.1 To enter, during the Promotion Period entrants must make a purchase via our online store, www.ScubaGearOnline.com.au ("Qualifying Purchase").

3.2 Entries are calculated on the following basis:

3.3 There is no limit on the number of entries an individual may accrue, provided each entry is calculated from a valid Qualifying Purchase in accordance with clause 3.2.

3.4 Incomplete, illegible, indecipherable, corrupted, or fraudulent entries will be deemed invalid and excluded at the Promoter's discretion.

3.5 The Promoter accepts no responsibility for entries lost, delayed, misdirected, or not received due to technical disruption, error, or otherwise.

4.1 There is one (1) prize available to be won, consisting of: Scubapro MK2 Evo + S270 regulator set (first and second stage), valued at $795.00 RRP.

4.2 Total prize pool value is approximately A$795.00 (inc. GST), based on the recommended retail value at the time of printing.

4.3 The prize is not transferable or exchangeable and cannot be redeemed for cash, unless otherwise agreed by the Promoter.

4.4 If a prize (or part of it) is unavailable, the Promoter reserves the right to substitute it with a prize of equal or greater value, subject to any written directions from a regulatory authority.

5.1 The draw will take place at 6/38 Mertonvale Circuit Kingston TAS 7050 on 4th August 2026 at 11:00 AEST.

5.2 The winner will be selected at random by electronic means, and in accordance with any applicable state regulations.

5.3 The winner will be notified by phone and/or email within one (1) business day of the draw and their name will be published on www.scubagearonline.com.au and/or on our social channels (Facebook and Instagram) on 4th August 2026, as required by the relevant permit conditions.

5.4 If a winner cannot be contacted, to confirm their shipping address, the shipping address given at the time of entry will be used to send the prize. The Promoter reserves the right, subject to any regulatory directions, to conduct an unclaimed prize draw on 11th August 2026 at 11:00 AEST at 6/38 Mertonvale Circuit Kingston TAS 7050.

6.1 The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age, and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who has tampered with the entry process.

6.2 If this Promotion is interfered with in any way, or is not capable of being conducted as reasonably anticipated due to any reason beyond the Promoter's control, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law to modify, suspend, terminate or cancel the Promotion, as appropriate.

6.3 To the extent permitted by law, the Promoter (including its officers, employees and agents) excludes all liability for any loss (including but not limited to direct, indirect, special or consequential loss), damage, personal injury, or death that occurs as a result of participation in this Promotion or as a result of accepting or using any prize, except for any liability which cannot be excluded by law.

6.4 Nothing in these Terms and Conditions limits, excludes, or modifies any guarantee, term, condition, warranty, or right conferred on entrants by the Australian Consumer Law or any other applicable law that cannot be excluded, restricted, or modified.

7.1 The Promoter collects personal information about entrants to conduct the Promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, prize suppliers, and, as required, to regulatory bodies.

7.2 Entry into this Promotion constitutes consent to the winner's name being published as required under clause 5.3.

7.3 The Promoter's Privacy Policy is available at https://www.scubagearonline.com.au/policies/privacy-policy. It sets out how entrants may access and correct personal information held about them, lodge a complaint, and how such a complaint will be handled.

8.1 These Terms and Conditions are governed by the laws of Tasmania, Australia.
